How EB-5 Investment Projects Create Jobs
and Support Your Visa

EB-5 regional centers channel invested capital into U.S. developments that generate economic growth and job creation. By participating in an EB-5 project, investors can pursue U.S. permanent residency while helping fund projects that support local economies.

Step 1. The investor makes an EB-5 investment

An investor commits the required capital to a qualifying EB-5 project. In many cases, the investment is made through a regional center that manages the project structure and compliance with EB-5 program rules.

Step 2. Investor capital is deployed into the development project

The investment funds are used to support the development of a project such as a residential community, resort, infrastructure project, or commercial development. These funds help finance construction, operations, and other project costs.

Step 3. The project creates qualifying jobs

As the project moves forward, construction activity and ongoing operations generate employment. EB-5 regulations require that each investor’s investment contributes to the creation of at least 10 qualifying jobs for U.S. workers.

Step 4. Investor files the I-526E petition

After making the investment, the investor files Form I-526E, which demonstrates that the investment was made in a qualifying EB-5 project and that the job creation requirement is expected to be met. Once approved, the investor can proceed with the immigration process.

Step 5. Conditional permanent residency

Following approval of the petition and completion of the visa process, the investor and their qualifying family members each receive a conditional Green Card in the United States.

Step 6. Removal of conditions

After the required jobs have been created, the investor files a petition to remove the conditions on their green card. Once approved, the investor and their eligible family members become permanent residents of the United States.

Regional Centers and EB-5 Investment Projects

Most EB-5 investments are made through USCIS-approved regional centers, which are organizations approved by the United States Citizenship and Immigration Services to sponsor and manage EB-5 investment projects. Regional centers work with developers to structure projects that meet the EB-5 Immigrant Investor Program’s requirements. While the regional center manages immigration compliance, the project developer is responsible for the project’s construction and operations.

For investors, regional center projects offer several advantages:

Passive business management

Investors are not required to actively manage the business. Instead, the project company is operated by experienced developers and management teams.

Indirect job creation requirement

Regional center projects can count indirect and induced jobs created through construction spending and economic activity.

Exemplar project approval

Many regional center projects receive I-956F exemplar approval, meaning the project structure and job creation methodology have already been approved by USCIS.

What is the alternative to regional center investing?

The alternative to investing through a regional center is a direct EB-5 investment. In a direct investment, the investor typically starts or actively manages a U.S. business and must create at least 10 full-time jobs for U.S. workers directly through that business. Because direct investments require active management and cannot count indirect job creation, many investors instead choose regional center projects.

To qualify for a U.S. green card through the EB-5 Immigrant Investor Program, investors must meet several key requirements:

Make the minimum investment

Invest $800,000 in a qualifying targeted employment area (TEA) project or $1,050,000 in a non-TEA project.

Create 10 jobs

Each investment must create at least 10 full-time jobs for U.S. workers.

Remain involved in the business management

Investors must have at least a policy-level role in the enterprise’s management.

Keep your investment at-risk

EB-5 capital must be placed at risk in a commercial enterprise for at least two years. Guaranteed returns are not permitted under program rules.

How the EB-5 Process Works for Rural Projects

Investing in a rural project under the EB-5 Immigrant Investor Program follows the same basic process as other EB-5 investments, but rural projects can offer additional advantages such as priority processing and access to reserved EB-5 visas.

Invest in a rural EB-5 project

The investor commits $800,000 to a new commercial enterprise (NCE) — the investment entity used to collect EB-5 capital from investors. The NCE pools these funds and invests them into a qualifying development project located in a rural targeted employment area (TEA), typically through a regional center-sponsored investment.

File Form I-526E

After the investment is made, the investor files Form I-526E with U.S. Citizenship and Immigration Services to demonstrate that the investment meets EB-5 program requirements.

Get conditional permanent residency

Once the petition is approved and a visa is available, the investor and eligible family members can obtain conditional U.S. permanent residency by filing Form I-485. 

Job creation through the project

The investor must keep their funds invested in the project for at least two years. The EB-5 investment must create at least 10 qualifying jobs for U.S. workers per investor, typically through construction and operational activity.

Remove conditions on the green card

After the required jobs are created, the investor files Form I-829 to remove the conditions on their green card and become a permanent U.S. resident.
